Please read these terms and conditions carefully before using the https://www.poop911.com website and pet waste removal services operated by POOP 911 (“us”, “we”, or “our”).

Terms and Conditions of Service:

POOP 911 and its employees guarantee the quality, reliability, and professionalism of our services. By accessing and using POOP 911 service, you, the customer, accept and agree to be bound by the terms and provision of this agreement. In addition, when using any of our services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the outlined guidelines, please do not use this service. All below items are predicated based on territory and subject to change at any time:

Access to Property:

By employing POOP 911, you are granting POOP 911 professionals’ access to designated yard or kennel areas of your property during the designated service date. If our technician is not permitted on your property for any reason, this occurrence will be noted and customer may be charged for full price of service.

Technicians are not permitted, nor required to enter a customer’s home. In no circumstances will this be allowed or required of any POOP 911 technician. There are and will be no exceptions to this rule.

Pricing:

POOP 911 pricing is determined based on respective territory. In addition, pricing is subject to change at any time. Upon beginning services, you accept this condition and will adjust payment accordingly if prices change at any point in time.  By ordering regular POOP 911 service, you are authorizing POOP 911 to charge your card following time of service in correlation with your chosen frequency of service and number of dogs.  Customer is responsible for providing payment information ahead of first service and will be charged payment in full following initial service. If card information is not provided, service will not begin. Following initial service, customer is responsible for payment following each recurring service. If payment in full is not received, POOP 911 reserves the right to halt services until payment in full has been received.

Service options:

Service options are solely based on territory and services assigned by respective franchise at given time. Service schedule availability can change based on business needs and general workday productivity. You, the customer, are responsible for notifying POOP 911 of any changes in number of dogs or frequency of services. Customer is also responsible for notifying POOP 911 of service cancellation and is required to do so 24 hours before service.

Referral:

POOP 911 will honor the referral policy wherein if you refer a friend and said person schedules a regular scooping service with POOP 911, referred customer will receive a free first cleanup. This initial free service only applies to the areas in which the offer is available.

Free First Cleanup:

Free first cleanup services are determined based on territory. During the initial free service, scooping is entirely free of charge, but any additional services will be charged according to territory’s pricing. This initial service is not charged as long as customer remains active for 1 – 3 months and is in good financial standing with POOP 911. FREE 1st Cleanup is a first-time client promotion and reserved as such, returning clients may be ineligible to this promotion. Returning clients may be required to pay an initial fee based on the number of dogs owned and the last time their yard was serviced for pet waste cleanup.

Inclement weather:

In the event of inclement or extreme weather conditions, POOP 911 reserves the right to delay or cancel services out of an abundance of caution. During this time, customer will be notified of such an event and services will be rescheduled or adjusted accordingly.

Aggressive Animals:

If our assigned POOP 911 technician is unable to access the designated yard area due to an aggressive animal presence, service on chosen day will be postponed or canceled. Service may be rescheduled for a later time, but customer will be charged a trip fee equaling up to the quoted cost of service.

Locked Property:

If the assigned POOP 911 technician is unable to access the designated yard space due to a locked gateway, and cannot otherwise access a customer’s property, service on chosen day will be postponed or canceled. Service may be rescheduled for a later time, but customer will be charged a trip fee equaling up to the quoted cost of service.

Governing Law:

These Terms shall be governed and construed in accordance with the laws of United States without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.

Terms and Conditions of Changes:

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least a day’s notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Terms and Conditions of Intellectual Property:

The Service and its original content, features and functionality are and will remain the exclusive property of POOP 911 and its licensors.
